These General Terms and Conditions (hereinafter referred to as “Terms”) represent a legally binding agreement between Koussikou.ch (referred to as “www.Koussikou.ch,” “we,” “us,” or “our”) and you, our esteemed customer.

By accessing or using our website, you affirm your commitment to abide by and be bound by these Terms. We urge you to review them carefully prior to making any purchases. Should you disagree with any aspect of these Terms, we kindly ask that you refrain from accessing the website or utilizing any of our services.

Conclusion of contract

By placing an order on the www.Koussikou.ch platform, the customer submits an offer to conclude a sales contract with Koussikou.ch. The order is therefore firm. The customer receives confirmation of receipt of this order (order confirmation). This confirmation does not constitute acceptance of the customer’s offer, but is only intended to inform the customer that his order has been received.

The purchase contract is only concluded when Koussikou.ch confirms the shipment to the address indicated by the customer by a second e-mail (shipment confirmation).

Koussikou.ch fulfills the purchase contract by delivering the ordered product to the Swiss Post.

Subject to availability

We strive to keep our product listings up to date, but availability may vary. If a product you ordered is unavailable, we will promptly inform you via email and discuss possible alternatives or refund options.

Voluntary Return Policy

Your satisfaction is our priority. If, for any reason, you are not satisfied with your purchase, you may return the product within three working days of receipt. The returned product must be complete, unused, undamaged, and in its original packaging.

We will refund the purchase price upon receiving the returned product and necessary banking or postal details.

Terms of payment

Prices are in Swiss francs and include shipping costs. All prices include 0% VAT. We reserve the right to change prices. The current prices which can be consulted online at the time of the order apply. Typographical errors and pricing errors are reserved.

Customers can make payments through the following methods:

Koussikou.ch reserves the right to verify customer data through third-party companies.

Shipping costs

All orders from CHF 100.- are delivered free of charge. If the amount of the order does not exceed CHF 100, we will charge you CHF 10.50.- for postage.

Delivery

The goods are delivered by Swiss Post to the delivery address indicated by the customer. The delivery area is limited to the territory of the Swiss Confederation (including Liechtenstein).

Koussikou.ch reminds that all information on the delivery times of a product are only expected information and approximate indicative values. They do not constitute binding or guaranteed delivery times. If delivery times should change due to availability, the customer will be informed by Koussikou.ch.

Koussikou.ch is entitled to make partial deliveries at any time, provided that they are reasonable for the customer.

Transport damage (visible and hidden) and incorrect deliveries must be reported within five days of receipt of the shipment. In this case, the product should not be used.

Retention of title

The goods remain the property of Koussikou.ch until full payment of the purchase price. The customer grants Koussikou.ch the right to register a reservation of title in the register of reservation of title.

Warranty

Koussikou.ch exclusively sells original and new products from leading manufacturers known for their quality. Since Koussikou.ch does not manufacture these products itself, it does not influence their functionality. Therefore, Koussikou.ch excludes any warranty for these products, unless explicitly provided by the manufacturer.

However, Koussikou.ch authorizes its customers to directly exercise warranty rights with the manufacturer as specified in the manufacturer’s warranty policy.

The provision of services in accordance with these T&Cs & other contractual provisions.

Claims for damages for impossibility of performance, breach of contract, negligence and tort are totally excluded against Koussikou.ch, provided there is no intentional action or gross negligence, and against the Koussikou.ch executing agents. Liability for indirect damages and consequential damages arising from use, improper workmanship or loss of performance is excluded. Koussikou.ch liability for its own fault and that of its employees and legal representatives is limited to intent.

Koussikou.ch is not responsible for transport damage. These must be claimed directly from the parcel deliverer (Swiss Post).

Final provisions

Swiss law applies.

If the customer is a trader, Dietikon is the exclusive forum for all claims related to the business relationship.

If the customer is a consumer, the place of jurisdiction is determined in accordance with Article 22 of the law on the place of jurisdiction.

These terms and conditions may be changed at any time. The current version can be consulted on www.Koussikou.ch and is deemed accepted by the client from the date of publication.
